Welcome to Ops Atlas. By accessing or using our services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Ops Atlas ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Ops Atlas is an operations platform that provides monitoring, deployment management, Redis management, database tools, and Docker registry management for DevOps teams. The Service is available as:

• Self-Hosted (Open Source): Free under the MIT License
• Cloud Hosted: Managed service with various pricing tiers

3. Open Source License

The self-hosted version of Ops Atlas is released under the MIT License. This means you can:

• Use the software for any purpose (personal, commercial, etc.)
• Modify the source code
• Distribute copies
• Include in proprietary software

4. User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for illegal activities
• Scrape, crawl, or spider the Service without permission
• Resell or redistribute the Service without authorization

6. Cloud Service Terms

For users of our Cloud Hosted service:

Service Level

• We aim for 99.9% uptime for paid plans
• Scheduled maintenance will be announced in advance when possible
• Service credits may be available for extended downtime (see SLA for details)

Data Handling

• You retain all rights to your data
• We will not access your data except as necessary to provide the Service
• Data is encrypted in transit and at rest
• You can export or delete your data at any time

7. Payment Terms

For paid plans:

• Billing: Subscriptions are billed in advance on a monthly or annual basis
• Refunds: We offer a 14-day money-back guarantee for new subscriptions
• Price Changes: We will notify you at least 30 days before any price increases
• Cancellation: You may cancel at any time; access continues until the end of the billing period
• Taxes: Prices may not include applicable taxes, which will be added at checkout

The Service and its original content (excluding open-source components), features, and functionality are owned by Ops Atlas and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used without prior written consent.

The Service may integrate with or contain links to third-party services. We are not responsible for the content, privacy policies, or practices of third-party services.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

14. Changes to Terms

We may revise these Terms at any time. Material changes will be notified via email or prominent notice on our website at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with applicable laws based on your location:

• For EU/EEA users: Laws of your country of residence
• For all other users: Laws of the jurisdiction where the operator resides

Nothing in these Terms affects your statutory rights as a consumer under applicable local law.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation by contacting us at legal@opsatlas.io.

If negotiation fails within 30 days, you agree to attempt mediation before pursuing other remedies. For EU consumers, you may also use the EU Online Dispute Resolution platform.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ops Atlas regarding the Service.
